Welcome to WeCar! These Terms of Service (“Terms”) govern your use of the WeCar platform (the “Platform”) and its services. By accessing or using the Platform, you agree to comply with and be bound by these Terms.


1. Introduction

WeCar provides a peer-to-peer car-sharing platform connecting vehicle owners (“Hosts”) with travelers (“Guests”) seeking vehicle rentals in Quintana Roo, Yucatán, and surrounding regions. The platform facilitates transactions between Hosts and Guests but does not own or operate any vehicles.


2. Eligibility

To use the Platform, you must:

• Be at least 18 years old.

• Hold a valid driver’s license.

• Provide accurate and complete information during registration.

• Use a personal email address (e.g., Gmail, Hotmail) for authentication.


3. Account Creation and Use

3.1 Account Responsibility

You are responsible for safeguarding your account credentials. You agree not to share your account with others and to notify WeCar immediately of any unauthorized access.

3.2 Personal Use Only

The Platform is intended for personal, non-commercial use. Misuse, including using the Platform to solicit illegal activities or provide fraudulent information, is strictly prohibited.


4. Booking and Payment

4.1 Booking Requests

When a Guest submits a booking request:

• The Host has up to 8 hours to accept or decline the request.

• Payment is pre-authorized but only processed upon the Host’s acceptance.

4.2 Pricing and Fees

• Guests agree to pay the total rental cost, which includes the rental fee, applicable taxes, and any additional fees (e.g., delivery charges).

• Hosts agree to pay a service fee deducted from their earnings if applicable.

4.3 Trip Modifications

• Guests may request modifications to their trip, including changes to dates or locations, by sending a trip modification request to the Host through the Platform.

• Hosts have the right to accept or decline trip modification requests.

• Guests and Hosts must discuss and agree upon trip modifications prior to a request being sent to ensure smooth communication and avoid misunderstandings.

• Any modification must comply with the Cancellation Policy and may affect the total cost of the trip.


5. Cancellation Policy

Cancellations are subject to the WeCar Cancellation Policy. Guests and Hosts should review this policy to understand their rights and responsibilities in the event of a cancellation.


6. Host Responsibilities

Hosts must:

• Ensure their vehicle is safe, legally registered, and insured (if required).

• Provide accurate vehicle descriptions and clear pickup instructions.

• Communicate promptly with Guests.


7. Guest Responsibilities

Guests must:

• Treat the Host’s vehicle with care and return it in the condition received, except for normal wear and tear.

• Abide by all local traffic laws and restrictions.

• Notify the Host immediately in case of damage, accidents, or delays.


8. Prohibited Activities

Users must not:

• Use the Platform for illegal activities.

• Misrepresent their identity or intent.

• Tamper with or damage the Host’s vehicle intentionally.


9. Liability and Disputes

WeCar:

• Facilitates transactions but is not a party to any rental agreements.

• Is not liable for vehicle damage, accidents, or disputes between Hosts and Guests.

• Will mediate disputes if necessary but reserves the right to make final decisions.


10. Privacy

Your data is handled in accordance with the WeCar Privacy Policy. By using the Platform, you consent to the collection, use, and sharing of your information as outlined in the Privacy Policy.


11. Termination

WeCar reserves the right to suspend or terminate accounts for violations of these Terms or misuse of the Platform.


12. Governing Law

These Terms are governed by the laws of Quintana Roo, Mexico. Any disputes shall be resolved in the courts of Quintana Roo, Mexico.


13. Changes to Terms

WeCar may update these Terms periodically. Users will be notified of significant changes, and continued use of the Platform constitutes acceptance of the revised Terms.
